Acceptance
The “Terms and Conditions” govern the sale of products on the “lavion.com.au” website (“website”). The website is operated by J.L Scahill & R.A Scahill under the trading name L’avion (ABN 82 072 548 129). Please read the terms carefully. Using this website and placing an order with L’avion indicates acceptance of these terms. L’avion reserves the right to amend these terms from time to time, without any notice to you. Amendments take effect when posted on the L’avion website and apply to all orders placed subsequently.
The sale of products on the website are only available to individuals who can make legally binding contracts. Therefore, you must be over the age of 18 years and be legally able to enter into a binding contract.
Orders
On placement of an order for a product, you agree to pay the price specified in the order, including the delivery costs and any other charges or taxes. Subject to payment in full, and subject to abiding by these terms and conditions, L’avion agrees to supply the product and delivery the product to the delivery address specified by you at the time of the order.
L’avion reserves the right to accept or reject your order for any reason, including, without limitation, the unavailability of any product, an error in either the price or product description on this website, or an error in your order. Your contract with L’avion will become effective only when you receive confirmation of receipt and payment of your order.
An order is not final until the product has been dispatched to you. In certain circumstances L’avion may restrict multiple quantity sales to a single purchaser or delivery address. In such cases, if L’avion cancels all or part of your order, you will be notified before the product is dispatched and relevant refund payments will be made to you.
Prices
All prices including products, services, delivery and other charges displayed on this website are current at the time of issue, but may change at any time and are subject to availability. L’avion is not bound by incorrect pricing posted on the website in error.
Prices indicated on the website are in Australian dollars. If the credit card that you use is in a foreign currency, your card issuer will determine the exchange rate applied. Your card issuer may also impose additional fees or charges. The currency conversion tools on the website are only estimates of exchange rates and any such rates cannot be guaranteed by L’avion.
Taxes and Duties
Goods and services tax (GST) is applied at a rate of 10% to all purchases within Australia and is included in the retail price on the website.
For international orders, the GST will be removed at the checkout when your destination is selected. Please be aware that as the recipient you are liable for all import duties or any additional taxes imposed by the country that you are shipping to. Payment of these may be necessary to release your order from customs on arrival. Please check your local customs procedures regarding taxes.
Delivery and Insurance
L’avion endeavours to dispatch orders for in-stock products within 24 hours after receipt of an order. However there may be circumstances in which the order turnaround time is not met. The delivery times are indicative only and L’avion will not be liable for any failure to meet these delivery times.
All packages are insured from the time of dispatch to the time they are signed for upon delivery. We cannot take responsibility for items that are damaged or lost once they have been signed for. It is your responsibility to ensure that there will be a contact at the delivery address you provide that is authorised to sign for your delivery. We cannot delivery to post office boxes.
Returns and Refunds
If you are not happy with your purchase from the L’avion website we are happy to exchange, credit or refund your original method of payment, providing that: (a) You register the return within 7 days of receipt of the goods, (b) You return the product to us within 14 days of registering your return request, (c) the returned product is in saleable condition, unused, unwashed, unworn and undamaged, and in its original packaging with original garment tags attached and including (if applicable) dust bags and gift boxes.
If you return a product in accordance with the above terms, L’avion will refund the price paid, less delivery and return postage costs and any other taxes, duties or charges imposed in respect of the product.
If goods are faulty you may choose between a refund, exchange or credit along with reimbursement by L’avion of postage costs incurred.
Please allow up to 2 weeks for your return to be processed. Refunds can only be credited back to the original form of payment.
How to return your item -
Return to us the item within 14 days of your purchase, unworn and unwashed with all original tags attached to garment.
Please include with your return:
- The original receipt
- Return/Exchange Goods Forms (L'avion will send via email upon a returns request) completed and signed.
If you wish to exchange your purchase please include a postage paid, self-addressed bag sufficient to return your purchase to you.

As soon as the return has been received, a replacement product will be shipped or your account credited or refunded.
If you feel that your return falls outside of our policy, please notify us by email on customercare@lavion.com.au
Personal Information
In order to purchase products from the website, you will need to create a L’avion account prior to making a purchase. You must also create a L’avion account to engage with the L’avion community and to receive news and product information from time to time, though you may opt-out at any time by using the unsubscribe link on any of our communications.
As an account holder you are required to provide L’avion with accurate personal information. Provision of another person’s details as your own will not be deemed acceptable.
Any personal information collected by L’avion shall not be disclosed to any third party unless such a disclosure is authorised or required by law, or you have expressly consented to such a disclosure. L’avion otherwise relies on its Privacy Policy.
Disclaimer and Liability
While the information contained in the website is believed to be accurate and current, it is provided by L’avion in good faith on an "as is" basis. L’avion, its' owners and employees make no representation or warranty as to the reliability, accuracy or completeness of the information contained on the website and none of them accept any responsibility arising in any way (including negligence) for errors in, or omissions from, the information contained in the website.
To the extent (if any) that the content of the website does not satisfy the laws of a country other than Australia, it is not directed to persons in those countries and they should not use the website.
Neither L’avion nor its affiliates, directors, partners, employees, agents, or contractors, will be liable for any damages whatsoever arising out of, or in any way related to, the use of this website and any other website linked to this website, including loss or damage suffered as a result of negligence. This limitation applies to direct, indirect, consequential, special, and punitive or other damages you or others may suffer, as well as damages for loss of profits, business interruption or the loss of data or information.
You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website, or the use by any other person using your registration details.

L’avion cannot guarantee that any file or program available for download and/or execution from or via this website is free from viruses or other conditions which could damage or interfere with data, hardware or software with which it might be used. You assume all risk of use of all programs and files on this website, and you release L’avion entirely of all responsibility for any consequences of its use.

Defective Products
A defective product is a product that is not of saleable quality, does not correspond with its description, or where a defect in materials or workmanship becomes apparent to you and is notified to L’avion within three months of receipt.
Products damaged by accident or misuse, by use other than in accordance with their specifications (for example, improper cleaning), or by normal wear and tear, are not defective products.
Before returning a defective product, you must notify L’avion of the details and reason for the return. Where practicable, L’avion will arrange for the repair of defective products. If a product cannot be repaired, L’avion will provide a refund of the price paid, including delivery costs.

Security
L’avion uses industry-standard security and encryption for communication of confidential information over the internet. Credit card transactions are processed using E-Way, an online payment gateway. L’avion does not receive or store credit card details. Please refer to the Privacy and Security link on this website for further details.
Gift certificates
Gift certificates are not refundable and cannot be exchanged for cash or store credit. They must be redeemed in their entirety in a single transaction. Please note that gift certificates will expire 12 months after the original purchase date. We offer free shipping on gift certificates provided that they are not combined with other product in the same order. Gift certificates must be purchased individually to take advantage of the free shipping option in the checkout.
Product Representation
We have made every effort to accurately display the colours of our products on our website. However, please note that the colours may vary depending on individual computer monitors. Picture resolution and photography lighting. We cannot guarantee that your monitor’s display will exactly reflect the colour of the product upon delivery to you.
